1. Definitions

In these Terms and Conditions:

  • "Service" refers to the property rental services provided by Lumina Haven.
  • "User," "You," or "Guest" refers to any individual or entity accessing our website or using our rental services.
  • "We," "Us," or "Company" refers to Lumina Haven.
  • "Property" refers to any residence listed for rental through Lumina Haven.
  • "Agreement" refers to the rental contract formed when a booking is confirmed.
  • "Website" refers to our online platform accessible at luminil.info.

2. Acceptance of Terms

By accessing our website, making an inquiry, or completing a booking, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you should not use our services.

These terms constitute a legally binding agreement between you and Lumina Haven. We reserve the right to modify these terms at any time, with changes effective upon posting to our website. Continued use of our services after modifications indicates acceptance of the updated terms.

3. Eligibility

You must be at least 18 years of age to book properties through Lumina Haven. By making a booking, you represent that you have the legal capacity to enter into binding contracts under Thai law and the laws of your jurisdiction.

If you are booking on behalf of a group, you represent that you have authority to bind all group members to these terms and that all members meet the age requirement.

4. Service Description

Lumina Haven provides residential property rental services across various locations in Thailand, including island destinations, mountain regions, and riverfront areas. Our services include:

  • Property selection and booking coordination
  • Pre-arrival planning assistance
  • Transportation arrangement coordination
  • Provisioning services (when requested)
  • Guest support during rental periods
  • Local activity recommendations

Service availability and specific features vary by property and location. We reserve the right to modify service offerings without prior notice.

5. Booking Process and Confirmation

5.1 Booking Requests

Submitting an inquiry or booking request does not constitute a confirmed reservation. Bookings become binding only when we send written confirmation via email.

5.2 Property Availability

Properties are subject to availability. We make reasonable efforts to maintain accurate availability information but cannot guarantee that any property will be available for requested dates until booking is confirmed.

5.3 Booking Modifications

Requests to modify confirmed bookings are subject to property availability and may incur additional fees. Modifications must be requested in writing to [email protected] at least 14 days before the rental start date.

6. Pricing and Payment Terms

6.1 Rental Rates

Rental rates are quoted in Thai Baht (฿) and are subject to change without notice until booking confirmation is received. Rates include property accommodation and specified amenities. Additional services such as transportation coordination, provisioning, or special activities may incur separate fees.

6.2 Payment Schedule

Payment terms are as follows:

  • Deposit: 50% of total rental cost due within 48 hours of booking confirmation
  • Balance: Remaining 50% due 30 days before rental start date
  • Late bookings (within 30 days of rental start): Full payment required within 48 hours of confirmation

6.3 Security Deposit

A refundable security deposit may be required depending on the property. Deposit amounts range from ฿20,000 to ฿100,000 and are due with the final balance payment. The deposit will be refunded within 14 days after checkout, subject to property inspection confirming no damages or violations of rental terms.

6.4 Payment Methods

We accept payment via bank transfer, credit card (processing fees may apply), or other methods as specified in your booking confirmation. All payments are processed through secure third-party payment providers.

6.5 Taxes and Fees

Rental rates include applicable Thai VAT (7%). Additional local taxes, tourism fees, or utility charges may apply depending on property location and will be specified in the booking agreement.

7. Cancellation and Refund Policy

7.1 Cancellation by Guest

  • More than 60 days before rental: Full refund minus 10% administrative fee
  • 30-60 days before rental: 50% refund of total rental cost
  • 15-29 days before rental: 25% refund of total rental cost
  • Less than 15 days before rental: No refund

Cancellations must be submitted in writing to [email protected]. The cancellation date is determined by when we receive your written notice, not when you send it.

7.2 Cancellation by Lumina Haven

We reserve the right to cancel bookings due to property unavailability, safety concerns, force majeure events, or guest violations of these terms. In such cases, we will provide full refund of payments made or offer alternative property options of comparable quality.

7.3 No-Show Policy

Failure to arrive on the scheduled rental start date without prior cancellation notice will result in forfeiture of all payments with no refund.

8. Guest Responsibilities and Conduct

8.1 Property Care

Guests are responsible for treating properties with care and respect. You agree to:

  • Use properties in a reasonable and responsible manner
  • Report any damages or malfunctions promptly to our coordination team
  • Return properties in the same condition as received, accounting for normal wear
  • Follow all property-specific rules and guidelines provided
  • Respect noise restrictions and neighbor privacy

8.2 Prohibited Activities

The following activities are strictly prohibited:

  • Smoking indoors (unless property specifically permits)
  • Unauthorized parties or events
  • Illegal activities or violations of Thai law
  • Exceeding maximum occupancy limits
  • Subletting or transferring rental to third parties
  • Bringing pets without prior written approval
  • Using properties for commercial purposes

8.3 Compliance with Laws

Guests must comply with all applicable Thai laws and local regulations during their rental period. This includes but is not limited to visa requirements, immigration regulations, and local ordinances.

9. Liability and Disclaimers

9.1 Property Condition

Properties are provided "as is" based on the descriptions and information supplied. While we make reasonable efforts to ensure accuracy, we do not guarantee that properties will meet all guest expectations or that facilities will function flawlessly at all times.

9.2 Limitation of Liability

To the fullest extent permitted by Thai law, Lumina Haven shall not be liable for:

  • Personal injury, illness, or death occurring during rental periods
  • Loss or damage to personal property
  • Service interruptions (utilities, internet, etc.)
  • Natural events, weather conditions, or force majeure circumstances
  • Third-party service failures (transportation, provisioning, activities)
  • Consequential, indirect, or incidental damages

Our maximum liability for any claim arising from rental services shall not exceed the total amount paid for the specific rental period in question.

9.3 Guest Insurance

We strongly recommend guests obtain comprehensive travel insurance covering trip cancellation, medical emergencies, personal liability, and personal property. Lumina Haven is not responsible for costs arising from events covered by standard travel insurance policies.

10. Indemnification

You agree to indemnify, defend, and hold harmless Lumina Haven, its owners, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:

  • Your violation of these Terms and Conditions
  • Your violation of any rights of third parties
  • Damage to properties beyond normal wear and tear
  • Your violation of applicable laws or regulations
  • Any injury or damage caused by your actions or those of your guests

11. Force Majeure

Neither party shall be liable for failure to perform obligations due to circumstances beyond reasonable control, including but not limited to: natural disasters, severe weather, pandemics, government restrictions, civil unrest, terrorism, or other force majeure events.

In such cases, we will work with guests to reschedule rentals or provide refunds on a case-by-case basis, considering the specific circumstances and any costs already incurred.

12. Privacy and Data Protection

Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms and Conditions. By using our services, you consent to data processing as described in the Privacy Policy, available at Privacy Policy.

13. Intellectual Property

All content on our website, including text, images, logos, and property descriptions, is owned by Lumina Haven or licensed to us and protected by copyright and trademark laws. You may not copy, reproduce, distribute, or create derivative works without written permission.

You are granted a limited, non-exclusive license to access and use our website for personal, non-commercial purposes related to booking rental properties.

14. Dispute Resolution and Governing Law

14.1 Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Thailand, without regard to conflict of law principles.

14.2 Jurisdiction

Any disputes arising from these terms or use of our services shall be subject to the exclusive jurisdiction of the courts of Bangkok, Thailand.

14.3 Informal Resolution

Before initiating formal legal proceedings, parties agree to attempt resolution through good faith negotiation. Disputes should first be directed to [email protected] for informal resolution efforts.

15. Severability

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. Invalid provisions shall be modified to the minimum extent necessary to make them valid while preserving the parties' original intent.

16. Assignment

You may not assign or transfer your rights or obligations under these terms without our prior written consent. We may assign our rights and obligations to any affiliate or in connection with a merger, acquisition, or sale of assets.

17. Entire Agreement

These Terms and Conditions, together with our Privacy Policy and any specific rental agreement, constitute the entire agreement between you and Lumina Haven regarding use of our services and supersede all prior understandings or agreements, whether written or oral.
